I remember AirTrain whinging publically about this when the TMR released the post-CRR SEQ network map.
Nothing came of it because they know they can’t change the outcome.

I wouldn’t be surprised if Airtrain does try though. Particularly if they are successful with this initial claim for fare compensation.

I am no lawyer, but is it possible that the Government can take over Airtrain if they lose the lawsuit?

AirTrain’s financials would be dissected in court, as too will the contract.
Both will be made public.
The Government would need to prove in court that Airtrain’s compensation claim somehow breaches the contract, or they intentionally violated contract some other way.
The outcome would be the same.

The Government could technically order Queensland rail to suspend all services from Eagle Junction to the Airport until airtrain drop their lawsuit
That would then be the basis for another breach of contract against the State of Queensland.
